Islamic Divorce Process

 

1. First meeting (remote) with your client advisor to discuss your case

​2. Notice of application sent to Respondent 
 

3. Meeting (joint/separate) with your Client Advisor to reach an agreement

4. Talaq/ Khula pronounced by the Islamic Scholar* 

5. Talaq/ Khula certificate issued
 

 

 

 

*Important: where one party chooses not to engage in the divorce process properly, or where an agreement is not forthcoming, further mediation may be required (charged separately).

A case may need to be referred to the Jurist's office for formal determination. Any additional costs associated with this will be communicated in advance.

Frequently Asked Questions

My husband pronounced the talaq. Are we divorced?

According to Shia fiqh, simply pronouncing the talaq does not constitute a valid divorce. Other conditions must be satisfied e.g. the presence of two just witnesses during the pronouncement.

Can the husband revoke a Khula?

No, the husband cannot revoke a khula (it is ba'in). The couple will need to enter into a new marriage contract (Nikah) to reconcile. In limited circumstances, the wife may be able to retract her offer and to reinstate the marriage.

How long is the waiting period (idda) after divorce?

The idda is 3 menstrual cycles or 3 lunar months if the wife is not menstruating. If the wife is pregnant, the idda continues until childbirth. There is no idda if the wife is post-menopausal.

Can the husband revoke the talaq?

Yes, provided the talaq was a talaq raj'i (revocable) and this is done during the idda period. A new nikah is not required.
