Terms & Conditions: Islamic Divorce Package

1. Fee Structure & Payment Milestones

The Islamic Divorce Package fee is divided into two instalments:

First Instalment (Application Fee): This fee is due immediately upon submitting your application. This payment is strictly non-refundable, even if you later decide not to proceed with the divorce process.

Second Instalment (Progression Fee): This fee becomes due under either of the following circumstances:

We confirm that your Islamic divorce can be successfully issued or
You formally authorise us to escalate your case to a higher religious authority, deemed necessary by our team to attempt to secure a divorce.

2. Mediation Services

Included Allowance: The standard package includes up to two (2) hours of mediation with a member of the Client Care Team, a scholar or both.

Session-Based Charging: Any additional mediation required at any stage will be charged per session (up to 1 hour per session). If we choose to split a single hour of mediation over several separate calls, we reserve the right to do so at our discretion, but it remains chargeable as a session.

Rates and Impact of Non-Payment: Please refer to our dedicated fee page for up-to-date rates on extra sessions. If additional mediation is deemed necessary by our team but you are unwilling to cover this cost, we cannot proceed to the next stage of your process.

3. Spousal Non-Engagement

The progression of an Islamic divorce requires cooperation, but a case will not be blocked indefinitely by a non-engaging party. We are not responsible for any delays, complications, or a lack of resolution caused by your spouse's refusal to engage, and no refunds will be issued under these circumstances.
Our procedural steps for non-engagement depend on which party is non-responsi
ve.

Non-Engagement of the Wife: If the wife refuses to participate, ignores communications, or fails to attend scheduled mediation, we can Islamically proceed with the application without her engagement.

Non-Engagement of the Husband: If the husband fails to engage, we must take specific steps to ensure full Sharia compliance before a divorce can be pronounced. This will require either:

Relying on a valid, specific condition within the Islamic marriage contract (Nikah) that permits proceeding in his absence, or
Escalating the matter to a higher religious authority for a formal determination.

Please note that if spousal non-cooperation requires the case to be escalated to a higher religious authority to achieve an outcome, the Second Instalment must be paid in full to proceed.

No refunds will be issued for delays caused by spousal non-cooperation.

4. Escalation to the Higher Religious Authority

If your case requires a referral to a higher religious authority, the following conditions apply:

No Outcome Guarantees: We will take all necessary steps to support and advocate for your case to secure the divorce. However, the final ruling rests entirely with the authority; we cannot guarantee that a divorce will be issued.

No Refunds: The second instalment remains fully payable and is non-refundable, irrespective of the final outcome.

Complexity Surcharges: If a divorce is successfully secured after referral, additional charges may be incurred based on the complexity of your case. Any such fees will be communicated to you and agreed upon in advance.

5. Case Validity, Pausing, and Expiry

12-Month Live Window: Your Islamic divorce application remains active for exactly one (1) year from the date of initial submission.

Pausing the Process: You have the right to pause your application at any time. However, if you choose to pause your case and it is not finalised within the one-year timeframe, the application will automatically expire.

Re-Application & Fees: To resume a case after the one-year expiry date, you must submit a fresh application. Any fee reductions or financial adjustments for a re-application are granted purely at our discretion.

Exemption for Active Authority Referrals: The one-year expiry rule does not apply if your case is active and currently being processed or reviewed by a higher religious authority. Once a case is formally referred, it will remain open until a final determination is made, regardless of the timeline.

6. Withholding of Documentation

We reserve the absolute right to withhold the issuance of the Islamic Divorce Certificate in the event of any outstanding balances, unpaid mediation sessions, or non-payment of agreed surcharges.

7. Discretionary Exceptions

Exceptional Circumstances: Any exceptions, accommodations, or special considerations regarding late changes or cancellations due to exceptional circumstances are granted solely at the absolute discretion of our team and must be made in writing.

8. Inaccurate Information & Limitation of Liability

MRS Consultants acts in good faith based on the information provided by our clients. We are not responsible or legally liable for verifying or investigating the truth, accuracy, or authenticity of any statements, documents, or claims made by clients, particularly regarding marriage history, previous divorces, or spousal circumstances.
We reserve the absolute right to refuse any service application, halt ongoing casework, or completely reverse an issued decision if it transpires that any information provided to us was inaccurate, incomplete, or intentionally misleading. In such events, all fees paid up to that point remain strictly non-refundable.

 

 

Terms & Conditions: Islamic Marriage Package 

1. Deposit & Booking Confirmation

Non-Refundable Deposit: A deposit is required to confirm your booking for the Islamic Marriage Package. This deposit is strictly non-refundable under any circumstances.

Balance Payment: The remaining balance of the quoted package price must be paid in full no later than two (2) weeks prior to your scheduled ceremony date.

Short-Notice Bookings: Where the timeframe between your initial booking and the scheduled ceremony date is less than two weeks, the full amount must be paid upfront at the time of application.

2. Payment Reminders & Non-Payment Cancellation

Payment Reminders: We will issue a reminder for your final balance payment via WhatsApp, text message, or email.

Right to Cancel: If the second payment is not received by the two-week deadline, we reserve the absolute right to cancel your booking automatically.

Re-Application Required: In the event of a cancellation due to non-payment, your booking will be voided. You will be required to submit a fresh application and a new deposit to secure a new ceremony date.

3. Amendments & Cancellations (More than 2 Weeks' Notice)

Permitted Window: You may request changes or cancellations up to two weeks before your scheduled ceremony date. All requests must be submitted by 5:00 PM (GMT) on the final day of this notice period.

Surcharges & Availability: Requests to alter the date, time, or venue of the ceremony may incur additional fees. While we will make every effort to accommodate your new arrangements, we cannot guarantee our team's availability for the revised slot.

4. Late Notices & Cancellations (Less than 2 Weeks' Notice)

Late Cancellations: Cancellations made with less than two weeks' notice will incur the full cost of the package, and no refund will be issued.

Unaccommodated Late Changes: If you request a change to the date, time, or venue within two weeks of the ceremony and we cannot accommodate the new slot, the booking will be treated as a late cancellation, and the full package cost remains payable.

5. Islamic Marriage Certificates: Rules, Printing & Delivery

We reserve the right to withhold your marriage certificate if there is an outstanding balance.

Draft Approval Liability: Draft certificates are shared in advance. If you approve a draft and errors or changes are noticed after printing, you may incur additional charges to re-issue them.

Language Options: Certificates are standardly issued in English. Additional charges for dual-language certificates must be agreed upon in advance.

In-Person Delivery: Certificates are provided directly on the day of your in-person ceremony.

Remote Delivery: For remote ceremonies, certificates are posted to your chosen address for free (unless you request an e-certificate only). If you provide an incorrect address, additional charges will apply to issue and post replacements.

6. Scholar Attendance & Travel Window

Punctuality: The assigned scholar will always aim to arrive at the agreed ceremony time.

Travel Delay Buffer: We kindly request that clients factor in a 30-minute grace window following the scheduled start time to accommodate potential traffic or travel delays beyond our control.

Terms & Conditions: Consultations, Counselling & Coaching Sessions

1. Booking Holding Period & Payment

24-Hour Hold: Upon scheduling an appointment, your booking will be held for 24 hours.

Payment Confirmation: A booking is only officially confirmed once full payment is successfully received.

Automatic Cancellation: We reserve the absolute right to cancel your provisionally held booking without prior notice if payment is not completed within the 24-hour window. 

2. Session Format, Duration & Custom Fees

Remote Standard: All scheduled sessions are conducted remotely.

In-Person Exceptions: In-person consultations are available by request, and custom fees will be quoted on a case-by-case basis. 

Standard Duration: Standard sessions run for a maximum duration of up to one (1) hour.

Extended Sessions: Longer session durations may be agreed upon in advance. Fees for extended sessions will be calculated on a strict pro-rata basis. 

Unused Time Liability: If you choose to conclude a session early or use less than your assigned time slot, no refund or partial credit is due. 

Consultant Disruption: If the assigned scholar, counsellor or coach is unable to provide the full session time due to unforeseen circumstances, a pro-rata refund will be issued for the missed time.

3. Amendments & Cancellations (More than 48 Hours' Notice) 

Changes: You may request changes free of charge up to 48 hours before your scheduled appointment time.

Cancellation Fee: Cancellations made outside the 48-hour window will be refunded less a £15 administration fee.

Written Notice Required: All amendment or cancellation requests must be submitted in writing by email to contact@mrsconsultants.co.uk or via WhatsApp at +44 7448 592 173. 

4. Late Notices, No-Shows & Cancellations (Less than 48 Hours' Notice) 

Forfeited Fees: If less than 48 hours' notice is given, your session cost is completely forfeited and non-refundable. 

No-Show Policy: If you fail to attend your session without giving prior 48 hour notice, it will be treated as fully attended, and the full session fee will be consumed.

Emergency Requests: Requests to reschedule due to sudden emergencies will be reviewed on a case-by-case basis. Accommodation is not guaranteed and remains at the absolute discretion of our team.

5. Consultant Cancellations & Session Disruptions

Provider Cancellations: If a consultant or specialist cancels your appointment within the 48-hour window, we will offer you another slot. If a suitable alternative slot cannot be found, a full refund will be issued. 

Consultant Disruption: If the assigned scholar, counsellor or coach is unable to provide the full session time due to unforeseen circumstances, a pro-rata refund will be issued for the missed time. 

6. Package Discontinuation & Partial Refunds

Discount Forfeiture: If you purchase a session package at a discounted promotional rate but choose to discontinue the program early, your used sessions will be retroactively recalculated and billed at our full, non-discounted hourly rate.

Refund Calculation: Any remaining balance left on your account after this recalculation will be refunded to you, minus a flat £25 package termination fee. 

6. Discretionary Exceptions

Absolute Discretion: All administrative accommodations, package calculations, and policy exceptions are managed solely at the discretion of our team and must be made in writing.

Client Satisfaction and Complaints

Your satisfaction is important to us. If you have any concerns or wish to raise a complaint, please contact our management team in writing at contact@mrsconsultants.co.uk. We will review your matter objectively and acknowledge receipt of your complaint within 3 working days. Our team will endeavour to respond via email and/or telephone, taking all reasonable, transparent steps to ensure a fair and full resolution within 14 working days.
